TERMS AND CONDITIONS – YACHT DAY TRIP ONBOARD ‘SKAL of LONDON’
1. DEFINITIONS
“Company” refers to the yacht charter operator.
“Client” refers to the individual or entity making the booking.
“Charter” refers to the agreed yacht day trip service.
“Vessel” refers to the yacht provided for the Charter.
2. BOOKING AND PAYMENT
2.1 All bookings must be paid in full at the time of reservation.
2.2 No booking shall be considered confirmed until full payment has been received.
2.3 All payments are non-refundable, except as expressly stated in Clause 5 (Weather Cancellation).
3. NON-REFUNDABLE POLICY
3.1 Once payment has been made, the Client acknowledges and agrees that the booking is final.
3.2 No refunds, credits, or rescheduling will be provided for:
•Client cancellation
•Late arrival or no-show
•Changes in personal circumstances
•Illness, travel disruption, or force majeure affecting the Client
3.3 The Client is strongly advised to obtain comprehensive travel and cancellation insurance.
4. CLIENT RESPONSIBILITIES
4.1 The Client agrees to:
•Follow all lawful instructions given by the captain and crew onboard
•Comply with all safety regulations onboard
•Ensure that all members of their booking party are fit to travel.
• Disclose any health or fitness issues that may prevent them from undertaking the charter without issue.
4.2 The Company reserves the right to refuse boarding or terminate the Charter without refund if:
•Any person is deemed overly intoxicated, unsafe, or unfit.
•Safety instructions are ignored
•Behaviour is considered dangerous or inappropriate
5. WEATHER AND COMPANY CANCELLATION
5.1 The Company reserves the absolute right to cancel or modify the Charter at any time, including at short notice, where:
•Weather conditions are deemed unsafe
•Sea conditions are unsuitable
•Mechanical or operational issues arise
•Any circumstance affects safety
5.2 Such determination shall be made solely by the captain or Company and is final.
5.3 In the event of cancellation by the Company due to the above:
•A full refund of the booking fee will be issued
•No additional compensation, damages, or expenses will be payable
6. LIABILITY AND LIMITATION OF LIABILITY
6.1 To the fullest extent permitted by applicable law, the Company, its owners, employees, crew, agents, and contractors shall not be liable for:
•Personal injury or death where reasonable care has been exercised by the crew.
•Loss, theft, or damage to personal property
•Delays, interruptions, or changes to the Charter
•Any indirect, incidental, or consequential losses
6.2 The Client acknowledges that participation in marine activities involves inherent risks, including but not limited to:
•Slips, falls, and injuries onboard
•Sea conditions and weather exposure
•Swimming and water-related risks
6.3 The Client voluntarily assumes all such risks on behalf of themselves and their guests. Any guest who is unable to swim must disclose this to the crew before departure, so appropriate lifesaving equipment can be worn.
6.4 Nothing in these Terms excludes liability where such exclusion is prohibited by law, including:
•Gross negligence
•Fraud
•Death or injury caused by proven fault where liability cannot legally be excluded
7. INDEMNITY
7.1 The Client agrees to indemnify and hold harmless the Company against any claims, damages, liabilities, costs, or expenses arising from:
•The actions or omissions of the Client or their guests
•Breach of these Terms
•Failure to follow safety instructions
8. INSURANCE
8.1 The Vessel is professionally crewed and operated in accordance with applicable maritime regulations.
8.2 The Company maintains appropriate insurance as required by law.
8.3 The Client is responsible for obtaining personal insurance coverage for:
•Medical expenses
•Accidents
•Travel disruption
•Personal belongings
9. VESSEL STATUS
9.1 The Vessel is UK-registered and professionally operated.
9.2 The Charter is conducted in French waters and subject to applicable maritime and local regulations.
10. FORCE MAJEURE
10.1 The Company shall not be liable for failure or delay in performance due to events beyond its control, including but not limited to:
•Severe weather
•Government restrictions
•Natural disasters
•Strikes or mechanical failures
11. GOVERNING LAW AND JURISDICTION
11.1 These Terms shall be governed by and interpreted in accordance with the laws applicable to the operation of the Vessel and local jurisdiction of operation.
11.2 Any disputes shall be subject to the exclusive jurisdiction of the competent courts where the Company operates, unless otherwise required by mandatory law.
12. SEVERABILITY
12.1 If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
13. ACCEPTANCE OF TERMS
By making a booking and completing payment, the Client confirms that they:
•Have read and understood these Terms and Conditions
•Accept all provisions, including limitation of liability
•Agree on behalf of all guests included in the booking
14. ITINERARY VARIATION
14.1 The itinerary, route, destinations, timings, and activities of the Charter are indicative only and may be modified at any time.
14.2 The captain retains absolute discretion to alter the itinerary before or during the Charter for reasons including, but not limited to:
•Weather or sea conditions
•Safety considerations
•Port or regulatory restrictions
•Mechanical or operational requirements
14.3 Such decisions are final and made in the interest of safety and proper operation of the Vessel. No compensation, refund, or liability shall arise from any such modification.
15. PRIVACY AND IMAGE USE
15.1 The Charter may involve shared or group experiences where multiple guests are present onboard.
15.2 All guests agree to respect the privacy and image rights of others at all times.
15.3 Guests shall not photograph, film, record, or otherwise capture images or likenesses of other guests without their prior consent.
15.4 Guests shall not publish, distribute, or disseminate any images, video, or recordings of other guests without their explicit permission.
15.5 The Client agrees that they and their guests will comply with all applicable privacy and data protection laws in force in France, including rights relating to image, personal data, and private life.
15.6 The Company accepts no liability for breaches of privacy by guests but reserves the right to take appropriate action, including termination of the Charter without refund, in case of non-compliance.
